Building Impact is providing this website (the “Site”) to support Summer Boost which is an initiative aimed at supporting charter schools to provide high-quality summer learning opportunities. Building Impact takes your privacy very seriously. This privacy policy (“Privacy Policy”) applies to personal information collected through https://www.summerboost.org (“this Site”). By visiting and/or using this Site, you have agreed to this Privacy Policy.

Building Impact (“we” or “us”) reserves the right to change this Privacy Policy at any time by posting revisions to this Site. Such changes will be effective upon posting. 

WHAT INFORMATION DO WE COLLECT?

We may collect your contact information as well as any information that you share with us if you email us to request information. If you sign up for a webinar or other informational session, we may collect information from you to make sure you have access to that webinar or session.  If you would like us to assist you with a specific question, you will also need to provide us with other information (for example a description of why you are contacting us). If you send us comments, you will also provide us with other information in doing so.

If you submit an application so that your school can participate in the Summer Boost Program, you may be directed to a different site so that you can provide the information requested in the application form. We will use that information to evaluate your application and communicate with you. 

We may also decide to provide other resources, such as resources to help identify additional staffing personnel, to collect information from available personnel, or other resources to respond to other needs. If you are providing personal information to be considered as a resource, or to look for those personnel resources, you may be directed to a different Site so that you can provide the information requested.  We will use that information for the purposes for which it is collected.

When you use our Site, third parties working on our behalf (e.g., service providers), and third parties with whom we work (e.g., our partners), may place, view, and/or use “cookies,” web server logs, web beacons, and other electronic mechanisms to collect information about your use of this Site, and other digital properties. This information may include, but is not limited to, information about the IP address of your computer, browser type, language, device information, location data, operating system, the state or country from which you accessed this Site, the web pages and content visited, the date and the time of a visit, the sites you visited immediately before and after visiting this Site, the number of links you click within this Site, the functions you use on this Site and other information about how you use this Site. There may be other tracking technologies now and later devised and used by us or other third parties in connection with our Site. Most browsers are set to accept cookies by default. If you prefer, you can usually set your browser to disable cookies, or to alert you when cookies are being sent. However, note that portions of this Site may not function properly if you disable cookies. 

We require that users under 18 years of age or under the age of majority in their jurisdiction not submit personal information. In accordance with the U.S. federal Children’s Online Privacy Protection Act of 1998 (“COPPA”), we do not knowingly collect personal information from children under 13. We encourage parents to participate actively in their children’s Internet experience.

Do not provide information about others unless you are authorized to do so and consent to have all information used, disclosed, and transferred in accordance with this Privacy Policy. By submitting the information about others, you represent and warrant that you are authorized to do so and that you have received authorization from the person about whom you are providing the information and that person has consented to have all information used, disclosed, and transferred in accordance with this Privacy Policy.

We are not responsible for the collection, use, and/or disclosure of your information by affiliates and third parties, including, but not limited to, our partners. Such collection, use, and/or disclosure by partners, affiliates, or third parties are governed by their privacy policies.

How We Use and Disclose Information We Collect

We and the third parties and partners with whom we work may use the information collected for various reasons, including to provide you with information and assistance related to the Summer Boost program, for research, analysis, to better serve visitors to this Site, to compile or use aggregate and anonymous information about usage of this Site, other statistics etc.

We may also use or disclose your information if, among other things, we are required to do so by law or if acting with a good faith belief that such disclosure is reasonably necessary to: (1) comply with legal process, including, but not limited to lawful subpoenas; (2) enforce the Terms of Use of our Site; (3) respond to legal claims; (4) respond to your requests for services; or (5) protect the rights, property, or personal safety of our Site, its users, or the public.

SECURITY OF YOUR PERSONAL INFORMATION

Our security measures are designed to protect your information from loss, unauthorized access, disclosure, alteration, or destruction. Our site has physical, electronic, and managerial procedures, such as Secure Sockets Layer (SSL) software, which encrypts information you provide to us on this Site. This protects your information and helps prevent unauthorized access. Although we take those measures to protect against unauthorized disclosure of your information, we cannot guarantee that your information will never be disclosed in a manner that is inconsistent with this Privacy Policy. 

This Site may contain links to third-party sites, including to social networking sites. We are not responsible for any personal information you may provide while on such sites. Any information provided on such sites is governed by the privacy policies of the third-party sites.

GOOGLE ANALYTICS

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Site. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Site available to Google Analytics by instructing your browser to refuse all cookies, or by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

Google analytics may collect your IP address in addition to your usage of the Site, but no other personal data is shared with them. Google does not make your IP address accessible to Building Impact.

Your information will remain subject to the terms of this Privacy Policy even if our Site undergoes an organizational transition. However, we may transfer your information to a successor entity upon a merger, consolidation, or other reorganization in which our Site participates or to a successor not-for-profit assignee or licensee of all or substantially all of our Site’s assets. You hereby consent to such transfers and our Site may assign and transfer all of the rights, benefits, duties, and obligations of this Privacy Policy, under the circumstances described in this paragraph.

This Privacy Policy is governed by and incorporated by reference into the Terms of Service, available at https://www.summerboost.org/terms-of-use/ and should be interpreted in a manner consistent with that Terms of Use. Where an inconsistency exists between this Privacy Policy and the Terms of Use, this Privacy Policy shall control the relationship between the parties. If you believe we have violated this Privacy Policy, please contact us by email at summerboost@buildingimpact.co. If we do not satisfy your concerns regarding any alleged violation and you wish to pursue a claim against us, you agree to engage in mediation in the event that direct negotiations fail to resolve your concerns. The period for mediation shall be thirty (30) days unless the parties mutually agree to an extension. If mediation fails, the parties will arbitrate the dispute pursuant to the applicable rules of the Judicial Arbitration and Mediation Services (“JAMS”). Any arbitration shall take place in the State of New York before an arbitrator chosen from JAMS. Any award shall be final, binding, and conclusive upon the parties, and a judgment rendered thereon may be entered in any court having jurisdiction thereof. The arbitrator may award any form of remedy or relief (including injunctive relief, such as temporary restraining orders, preliminary and permanent injunctions) that would otherwise be available in court. Any award pursuant to said arbitration shall be accompanied by a written opinion of the arbitrator setting forth the reason for the award. To the extent not inconsistent with applicable laws, the arbitrator will have the authority to hear and grant motions and applications, including on an ex parte or expedited basis. The award rendered by the arbitrator shall be conclusive and binding upon the parties hereto, and judgment upon the award may be entered, and enforcement may be sought in, any court of competent jurisdiction. The prevailing party in any dispute relating to this Agreement shall be entitled to recover associated costs, including reasonable attorneys’ fees.

To the fullest extent permitted by applicable law, no arbitration under this Privacy Policy shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise.
